Law Enforcement in Digital Society (5 ECTS)

Brief course description: In this course the threats and opportunities of digitalisation for enforcing public bodies are addressed, with a focus on criminal regulation and legal safeguards for private individuals. The tension between democratic legitimacy and effective detection is discussed. Part of the tension is the necessity to cooperate with other actors in the safety domain. Policing powers are limited, so public-private cooperation should dwindle deficiencies. How public-private partnerships develop and fit within a legal framework is another theme. The following topics will be discussed:
1.Cybercrime and detection.
2.The attack of cybercrime as a mutual societal responsibility.
3.Cybercrime convention, the Laws on Computer crime and their implication for criminal prosecution.
4.The use of digital instruments by the police (reactive)
5.The use of digital instruments by the police (proactive)

Teaching method: Lectures, tutorials.

Assessment: Written exam (essay questions); a bonus can be acquired.
