Annual China EU Conference on Law & Economics: Rising to the challenge of rapid market transitions [POSTPONED]

Environmental degradation, Climate change and technological changes in the globalizing world impact economic markets and legal systems now more intensely and rapidly than ever before. Disruptive new technologies are phased-in more quickly and undermine scarcity and consequently mar- kets are transitioning fundamentally and rapidly. Legislators tend to react to these developments often in an ad-hoc fashion and struggle to regulate these markets in transition as they constitute ‘moving targets’. In many sit- uations the law constitutes the codified majority will of past legislatures, thus becoming a conservative force in society. This disconnection between the laws and the reality entails that regulation is generally ‘off-target’ and causes a detriment to society.

Scholarship has a prominent role in analysing the legal systems and advising regulators. The better lawyers’ understanding of rapid market transitions, the better their legal advice and the larger their contribution to society will be. Law & Economics is essential in this process since it brings the economic understanding of markets and their developments to lawyers and focuses on efficient and effective rule making.
