Programme: JUST

Instrument: JUST-AG-2016-01

Total Project budget: € 1,019,156.33

Duration: 21 months (01 June 2018 – 28 February 2020)

Full project title: EVIDENCE2e-Codex Linking EVIDENCE into e-CODEX for EIO and MLA procedures in Europe

Responsibilities:

RUG is a partner in the EVIDENCE2E-CODEX project

Project Summary:

The idea is to pre-pilot the EVIDENCE proposal and achievements together and with e-CODEX for the specific purposes of allowing the secure and trusted exchange of digital evidence among EU MS in the EIO and MLA context. Before piloting we envisaged with the EVIDENCE project that there is a need to generate the necessary awareness of involved actors by disseminating properly information about the procedures and the legal framework in which these procedures will be needed, a specific training to understand, accept and finally promote the electronic evidence exchange. The EVIDENCE2eCodex action will aim to cross fertilize stakeholders and infrastructure by rendering those ready to implement the change in treating electronic evidence and in exchanging it electronically.

Goals of this proposal will be to share with the practitioners involved, of legal and technical background, the availability of working instruments for digital cooperation in EIO-cases including digital evidences by:

- Creating a legally valid instrument to exchange digital evidence related to MLA and EIO procedures over e-CODEX

- Providing the legal and technical communities involved with ‘ready to use’ information on EIO, digital evidence and e-CODEX

- Developing a ‘true to life’ example of how electronic evidence can be shared over e-CODEX in a secure and standardized way to support MLA and EIO cases

- Developing first a theoretical approach for ‘large file handling’ if possible followed by a specification for the practical implementation, as digital evidence could come in ‘large size’;

- Action plan and guidelines for EU-wide implementation of the ‘true to life’ example.

To this proposal take part 9 Ministries of Justice of the EU MS, deriving from different law families and really paving the way to rendering the floor ready for the piloting since they will offer the opportunity to deal with the realities, challenges and gaps that concretely need to be bridged for realizing the exchange.
