New podcast episode of ‘Recht op nieuws’: the right to protest under pressure

19 March 2026

It is a topic that is more topical and sensitive than ever: the future of the freedom to demonstrate.

Demonstrations are currently receiving a great deal of media attention: building occupations, motorway blockades. As a result, calls to restrict the right to demonstrate are being heard with increasing frequency. But is that really necessary?

Presenter Jan Brouwer discusses this with Associate Professor Berend Roorda, a specialist in the right to demonstrate, and PhD candidate Noor Swart in the latest episode of the Recht op nieuws podcast.

A fundamental right, but...

The right to demonstrate is of great importance to the democratic legal system. It gives people the chance to participate in the political process outside of elections; it gives citizens the chance to voice their views on policy; it is an important opportunity for minorities to make their voices heard; and it acts as a safety valve: discontent can be expressed in a structured manner.

So why do we so often hear ‘The right to demonstrate is a fundamental right, but...’?

This new episode focuses on this question: how do we maintain the balance between freedom and public order without undermining the essence of the right to demonstrate?
