Workshop "Content and effects of contracts"
Dear Colleagues,
On 31 May and 1 June 2013, the workshop "Content and effects of contracts: the CESL in the European multi-level system of governance" will take place in Groningen (at the Hanze Sociëteit, Oude Boteringestraat 19).
The workshop is sponsored and organised by the Groningen Centre for Law and Governance (GCL). It is carried out in the framework of two GCL research programmes ("Public Interests and Private Relationships" and "User Friendly Private Law") and one NILG focus group ("Public Policy and Private Autonomy"). Moreover, the workshop is inspired by the Dutch-German comparative law cooperation in the framework of the Hanse Law School (HLS). Several speakers are actual or former HLS lecturers and students.
The focus of this workshop lies on Chapter 7 of the proposed EU Regulation on a Common European Sales Law (CESL):
Art. 66 Contract terms
Art. 67 Usages and practices in contracts between traders
Art. 68 Contract terms which may be implied
Art. 69 Contract terms derived from certain pre-contractual statements
Art. 70 Duty to raise awareness of not individually negotiated contract terms
Art. 71 Additional payments in contracts between a trader and a consumer
Art. 72 Merger clauses
Art. 73 Determination of price
Art. 74 Unilateral determination by a party
Art. 75 Determination by a third party
Art. 76 Language
Art. 77 Contracts of indeterminate duration
Art. 78 Contract terms in favour of third parties.
The two main questions that will be discussed during the workshop are:
1) Do Art. 66-78 CESL put the consumer in a better, equally good or worse position than the correspondent national law provisions?
2) Do Art. 66-78 CESL put commercial enterprises in a better, equally good or worse position than the correspondent national law provisions?
