Olha Cherednychenko and Marnix Wallinga advised the Dutch Consumer Association on possible reform of the Dutch Financial Supervision Act (Wet financieel toezicht (Wft)). They assessed to what extent this legislation is user-friendly from the consumer point of view. While the Financial Supervision Act contains many provisions aimed at ensuring financial consumer protection, the researchers concluded that this legislation is not easily accessible for consumers. This is particularly due to the lack of a systematic approach to the implementation of EU financial services legislation in Dutch law and the complexity involved in enforcing the financial supervision rules by means of private law.
