Prof. Dimitry Kochenov, an expert in EU constitutional law, explained in the Croatian newspaper Vecernji how Article 259 TFEU works. This provision outlines the procedure allowing Member States of the Union to bring each other to the Court of Justice of the EU for breaches of EU law. The provision is of crucial importance at the moment in the context of Croatian-Slovenian relations and the issue of the maritime border dispute between the two countries.Prof. Kochenov made it clear that without the support of the European Commission it is unlikely that Slovenia would stand serious chances to win, should it bring Croatia to Court.
