Dimitry Kochenov speaks to BBC World on a new Russian law aimed to undermine the ECHR
Prof. Dimitry Kochenov (EU Constitutional Law), who teaches at Princeton this academic year, gave extensive comments to BBC world radio (Russian service) on the legality and possible effects of Russia's recent law, allowing its Constitutional Court to block the execution of the decisions of international courts and tribunals in violation of Article 46 of the European Convention of Human Rights, but also in violation of the Russian Constitution's own Article 15, which establishes the principle of supremacy of international law and international agreements over the national law of the Federation. It is certain that the Constitutional Court of the country will only welcome the law, as it hinted at the need of having such an (unconstitutional) instrument in an earlier decision.
