The importance of municipalities, provinces, and water boards within society, the public sector, and the law has steadily increased over the past decades, and this development has not yet come to an end. Policy-determining principles such as ‘decentralized where possible, centralized where necessary,’ as we know them in environmental law and the social domain, stimulate this development. Due to this enlargement and transformation of the tasks of decentralized authorities, the law governing decentralized authorities themselves is also undergoing changes. For instance, various legal issues are at play regarding intergovernmental relations between, for example, the central government and municipalities. Renewed questions regarding the allocation and exercise of powers, and the democratic legitimacy of decisions, are also at play within the administrative levels of decentralized authorities themselves. The endowed chair focuses on the legal aspects of decentralization and the law of decentralized authorities across the full spectrum. Particular attention is paid to the institutional aspects of decentralization law and the position of decentralized authorities within the decentralized unitary state and in a European setting. The interplay between decentralisation law and substantive areas of law (such as environmental law) is also addressed.
Juliette van der Jagt studeerde Nederlands recht aan de Universiteit Utrecht (richtingen Staats- en bestuursrecht en Strafrecht). Aan die universiteit promoveerde ze in 2006 op het proefschrift ‘Milieuconvenanten gehandhaafd’, een milieu-, bestuurs- en civielrechtelijk proefschrift over de handhaafbaarheid en handhaving van convenanten gesloten tussen overheid en bedrijfsleven om milieudoelstellingen te realiseren.
Na vervolgens bijna tien jaar als advocaat bestuursrecht en gezondheidsrecht aan advocatenkantoor Pels Rijcken verbonden te zijn geweest, is zij sinds 2016 werkzaam bij de VNG. Daar heeft ze zich door de jaren heen met uiteenlopende onderwerpen beziggehouden waaronder open overheid, verkiezingen, elektronisch bestuurlijk verkeer en het algemeen bestuursrecht. Momenteel werkt ze als coördinerend juridisch adviseur aan de uitvoering van de Omgevingswet en het omgevingsrecht in brede zin.
Daarnaast is Van der Jagt bestuurslid van de VAR, Vereniging voor Bestuursrecht, en voorzitter van de redactie van het Sdu Commentaar Algemene wet bestuursrecht.
