Conditions of the University Translation and Correction Service

Conditions for translations and correction work carried out by the University Translation and Correction Service of the Language Centre of the Faculty of Arts of the University of Groningen.

Article 1    Terms and Definitions

a. Language Centre: the Language Centre of the Faculty of Arts of the University of Groningen.

b. University Translation and Correction Service (UVC): part of the Language Centre which provides translation and correction services.

c. Customer: the natural or legal person who commissions translation or correction work from the Language Centre (UVC).

Article 2    Commission

Acceptance by the Language Centre (UVC) of a commission for translation or correction work is conditional upon the Language Centre (UVC) first having seen and approved the text for translation or correction, and shall be confirmed in writing.

Article 3    Completion of Assignments

The Language Centre (UVC) shall ensure that the quality of the translation it provides complies with the standards by which experienced translators generally assess texts submitted for translation. The Language Centre (UVC) will only take account of further instructions from the Customer with regard to the translation content insofar as these are consistent with the quality requirements set out in the previous sentence.

Article 4    Cancellation of Commission

a. The Customer has the right unilaterally to cancel a commission for a translation or correction, on condition that he or she informs the Language Centre (UVC) in writing. The date of receipt by the Language Centre (UVC) of the notice of cancellation shall be the cancellation date.

b. If, on receipt of a written notice of cancellation from the Customer, the Language Centre (UVC) has not yet instructed a translator or corrector to undertake the work, the Customer shall be liable to pay the costs incurred up to the time of cancellation.

c. If, on receipt of a written notice of cancellation from the Customer, the Language Centre (UVC) has already instructed a translator or corrector to undertake the work, and this translator or corrector has already commenced work (including research activities), the Customer shall be liable to pay the full costs of the part of the work that has already been performed, including the translator's or corrector's fee and any additional costs on the part of the translator or corrector, as well as any costs as referred to in Article 4.b. The Language Centre (UVC) will make the completed part of the work available to the Customer if he/she so wishes. The Language Centre (UVC) will not be able to vouch for the quality of the work delivered in such an eventuality.

Article 5    Liability

a. The Language Centre (UVC) shall be liable to the Customer for attributable shortcomings in the implementation of the agreement to the extent that such shortcomings result from non-compliance with the levels of accuracy and professionalism that may be expected in the implementation of the agreement.

b. The liability of the Language Centre with regard to damage/losses suffered by the Customer as the result of late delivery, errors, omissions, incorrect terminology or other errors in a corrected text or translation supplied by the Language Centre (UVC) shall be restricted to the demonstrable direct damage/loss suffered by the Customer, on condition that this does not exceed the sum of the agreed fee and other costs agreed for the translation or correction work. The Language Centre (UVC) shall not be liable for any consequential damage on the part of the Customer or any third party, including at least trading loss, consequential loss, loss due to delays and loss of profit.

c. The Language Centre (UVC) shall not be liable for mistakes, omissions, incorrect terminology or other errors that are the result of ambiguity or a lack of clarity in the text provided by the Customer for translation or correction or of incorrect or incomplete information being provided.

d. The Language Centre (UVC) shall not be liable for damage resulting from the loss, destruction or damage of manuscripts, documents, papers or books entrusted to it, except in the event of gross negligence. The Customer shall submit his/her texts to the Language Centre (UVC) at his/her own risk.

e. The right to claim compensation within the meaning of this article shall lapse one year after the translation or corrected text has been delivered.  

Article 6    Objections

If the Customer has a complaint with regard to a translation or correction commissioned from the Language Centre (UVC), the Customer must notify the Language Centre (UVC) within eight working days (the first day being the day after the translation or correction has been sent to the Customer). Parties shall then consult with each other in order to find a satisfactory solution, in accordance with the quality of the translation as described in the first sentence of Article 3.  

Article 7    Copyright

Unless explicitly agreed otherwise in writing, all copyrights to translations produced by the Language Centre (UVC) shall be transferred to the Customer as soon as all financial and other obligations to the Language Centre (UVC) with regard to the work in question have been met.
