“Ethics comes before, during and after the law”, Giovanni Buttarelli, European Data Protection Supervisor.
For responsible research, ethics and data protection are intertwined. Based on the Netherlands Code of Conduct for Research Integrity, the university has a duty of care to facilitate the advice of an ethics board on how to make data openly available. In discipline-specific ethics codes, like the NETHICS code of conduct, also an assessment of compliance with the GDPR is included. RDO supports, together with the ABJZ, ethics boards to align expertise and to clarify dilemmas. For more information, please consult the pages of the ethics board in your faculty.
An example of integrating the ethical and legal considerations into the consent form can be found here.
The document Ethics and data protection has been drafted by a panel of experts at the request of the European Commission (DG Research and Innovation) and aims at raising awareness in the scientific community, and in particular with beneficiaries of EU research and innovation projects.
Please be aware that funders may include questions about data protection in the ethical assessment or the data management plan for the application of projects. Find more information on ERC applications here.
