Paper:The South China Sea Arbitration: Unsettling Distpute Settlement? The main topic this paper is the contribution of the arbitration between the Philippines and China to finding a solution for the controversies surrounding the South China Sea. Did the arbitration help to settle any disputes, or did it in fact unsettle the relations between the parties involved, or even worse, did it undermine the role of international law in dealing with complex issues related to maritime issues? These questions will be addressed by looking at three different aspects: the relevant legal regime (UNCLOS) and its characteristics; the UNCLOS mechanism for compulsory dispute settlement characterised as ‘peaceful, ‘compulsory & binding’, and ‘providing choice’; the contribution and risks for the settlement of disputes related to the South China Sea.
