Multi-level Labour Law and CSR (6 ECTS)

Brief course description: The aim of this module is to gain knowledge and insight in the field of Labour Law from a multi-level angle. Labour law is to be found in many different sources, national law including case law is still by far the most important legal source. Increasingly, labour law is to be found elsewhere: in the conventions of the International Labour Organization (ILO), in the case law of the European Court of Human Rights in Strasbourg and in EU directives and the case law of the Court of Justice of the EU in Luxembourg and also in private or public codes of conduct. The lawyer must be able to work with interferences between all these levels.
Substantively, the course will deal with fundamentals of labour law in a comparative perspective, e.g. the concepts of employed and self-employed, the main elements of dismissals’ law, freedom of association, the right to strike and collective bargaining. Other topics are equal treatment, child labour, forced labour and migrant workers and labour law. Finally, public and private codes of conducts concerning corporate social responsibility are becoming important sources of labour law. Also international framework agreements concluded by multinational corporations and global trade unions are becoming more important. These instruments are essential because multinational corporations operate at a global level, while (national) labour law is restricted territorially.
Teaching method: Lectures and in-class discussions.
Assessment: Essay exam including legal case studies.
