Leerdoelen | Competition law plays an important role in shaping the economies of most European states as well as the EU’s internal market. It is characterised by an integrated approach to law and economics and results in important behavioural rules for companies as well as public authorities. An academically trained competition lawyer is a designer of competition law documents that integrate economic insights and data with legal analysis. Using sound knowledge and application skills she or he can draft legal documents that describe and critically analyse the legal framework applicable. On the basis of this, she or he can come up with reasoned suggestions for changes to this legal framework. In short, this course will teach you to design legal documents on the basis of the competition law of the EU and economic insights. After successful completion of this course the student can: - Design a legal document concerning the competition law applicable to the actions of a public entity (e.g. granting state aid) in order to end, amend to defend these actions; - Choose the optimal route involving the competition laws of the EU and its Member States to ensure the best results for her/his clients; - Design secondary (decisions, case law) and tertiary (guidance, soft law) competition law. As is indicated above, designing means that you are capable of choosing a relevant theory, describe and apply this theory to a set of facts and able to critically analyse and review the results and to adapt, where necessary or desirable, the theory. |

The following topics are dealt with: - State aid control (Art. 107 TFEU) - Competition law relating to state intervention in the market (Art. 106 TFEU) - EU Market regulation and liberalisation - Enforcement and judicial review in competition law |
