Leerdoelen | In this course, the focus is put on electronic communications law or telecommunications law. The students who follow it will gain knowledge and understanding of this fascinating but highly dynamic and complex legal field by collecting, analyzing, applying and critically reflecting upon the different sources, including applicable legislation, case law and literature. In the course, the issues of European law, administrative law and civil law are explored as forming part of telecommunications law and being closely linked to each other. The course seeks to stimulate the students to actively participate in making a wide range of assignments and to adopt a critical legal thinking allowing them to address arising legal questions by considering not only legal but also technical, economic and societal aspects pertaining to telecommunications. In order to be able to do so, the students will be equipped with a spectrum of tools and skills to distill and assess legally relevant facts from a certain scenario and to construct effective legal arguments in a logical, consistent and correct manner. Moreover, they will develop the students' capacity of reflecting upon the interaction between this legal argumentation and the technical, economic and societal framework, within which telecommunications law functions. In addition to studying this particular legal field in a systematic manner and applying the acquired knowledge in practice, the students will be able to keep track of the relevant developments taking place in this area and make sure that their knowledge and skills are up-to-date. Having completed this course, the students will have all necessary instruments to make a conscious and well-substantiated choice regarding their further education and future career. |

Omschrijving | In the course, the following topics are dealt with: First of all, the system of the EU and international rules as well as the implementation thereof in the Dutch Telecommunications Act (and accidentally, other jurisdictions) as well as relevant developments, monitoring and enforcement are examined. The allocation of frequency spectra is also explored. In addition, attention is devoted to market access and subjects such as significant market power, standardisation, access to and interconnection of electronic communications networks and continuity are covered. Furthermore, universal services, users’ rights, end users’ and consumers' interests are discussed. Finally, subjects including confidentiality of electronic communications and security are addressed. |
