Upon completion of this course, a student can:- identify constitutional principles common to modern Western states;
- relate major historical events in the development of the Western state to the contemporary organization of that state;
- differentiate the functions of modern constitutions;
- indicate the prevailing mechanisms to incorporate the international and European legal order in the domestic legal order;
- debate mechanisms of achieving constitutional efficacy;
- analyze constitutional mechanisms to achieve both horizontal and vertical separations of powers;
- distinguish between presidential and parliamentary systems and, on the basis thereof, sketch the relationship between the executive and parliament,
- identify the basic challenges internationalization and Europeanization pose to both sovereignty and the constitutional position of national parliaments.

This introductory course in the field of Comparative Constitutional Law deals with a number of topics related to the concept of the role and function of public authority (based on a constitution) in the modern, Western state. Furthermore, it discusses themes that are central to the different types of constitutional framework that characterize democratic states. Some of the topics:- The history of constitutionalism: the American and French revolutions and the different forms of constitutions they gave birth to;
- The national constitution and international law;
- International and European constitutional developments.
- The functions of the constitution;
- The changing nature of the Constitution;
- Horizontal and vertical separation of powers;
- The organization and powers of the legislative;
- Constitutional efficacy;
- Challenges of Europeanisation;
- Populism.
At the exam, 80 out of 100 points can be earned. The remaining points can be earned by participating in an assignment in the field of comparative public law. |

- Not accessible for students who have passed Introduction to Public Law (RGPIR50310) before 1-9-2020.
