Leerdoelen Upon completion of this course, the student will achieve the following:
Final attainment levels knowledge and insight:
• Specialised knowledge and understanding of core international crimes and other gross human rights violations both from a legal and a criminological perspective;
• Specialised knowledge and understanding to solve problems related to the prevention and prosecution of international crimes and other gross human rights violations at the international, regional and domestic levels;
• Enhanced knowledge and understanding of the wider context in which international crimes and other gross human rights violations occur and how this knowledge could affect the functioning of the law;
• Enhanced knowledge and understanding of the wider international context in which international criminal law and international human rights law operate and the role they have to play in the prevention and prosecution of international crimes and other gross human rights violations.
Final attainment levels skills and attitude:
• The ability to independently collect, evaluate and apply knowledge from criminology and understand as well as critically reflect on the existing research and literature;
• The ability to independently collect, evaluate and apply relevant legislation, jurisprudence and literature related to a complex legal problem raised by the nature, prevention and prosecution of core international crimes and other gross human rights violations;
• The ability to conduct independent academic legal and criminological research on the nature, prevention and prosecution of core international crimes and other gross human rights violations;
• The ability to independently engage in academic discourse on the nature, prevention and prosecution of core international crimes and other gross human rights violations with peers from a variety of backgrounds;
• The ability to make a complex argument concerning the nature, prevention and prosecution of core international crimes and other gross human rights violations understandable in written and spoken English to peers from a variety of backgrounds.
Omschrijving Detailed legal and criminological study of specific international crimes and other gross human rights violations , including terrorism, and of the perpetrators of such atrocities. This course explores a diversity of mass violence crimes: war crimes, genocide, extermination, persecutions, feminicide, crimes of sexual violence, enforced disappearances, torture and terrorism. It overall adopts a two-fold (law and criminology) critical approach to fully grasp the concept of international criminality in terms of prohibited acts and human rights violations, protected victims and identity of perpetrators. Students will study the relevant legal instruments and case-law at the domestic, regional and international levels. They will also be taught how to critically reflect on criminological research and literature. This will provide them with a full understanding of the causes and true nature of these mass crimes and human rights violations. It will ultimately allow for the identification of the challenges faced by (international) criminal law and (international) human rights law in preventing, investigating and punishing international crimes and other gross human rights violations and for the assessment of the effectiveness of legal and enforcement measures at the international, regional and national levels.
