Leerdoelen The student has a thorough understanding of the field of comparative law in general and the functional method in particular. S/he has a thorough insight in Dutch, French, German and English property law and the similarities and differences between property law in the above legal systems. S/he is able to independently assemble, assess and apply relevant facts, legislation, case law and literature in order to solve complex issues in property law.
Omschrijving The course starts with an introduction to comparative law in general. Specific attention is given to the use of the functional method of practicing comparative law. Also the importance and limitations of comparative law for various legal professions is discussed. Students are introduced to the various legal systems derived from Roman law, and especially to French and German law. Students learn to appreciate how different solutions have been found for the same legal problems in various European codes. Furthermore students will study the Anglo-American legal system. Next to examining the general structure of this system, students will be familiarised with basic issues of English property law. The course is completed by a comparison of modern continental European private law and the Anglo-American system.
