Uitgebreide vaknaam Competition Law in the Digital Market
Leerdoelen Having successfully completed this course the student will have thorough knowledge of the parts of EU competition law that are most relevant to digital markets (Article 101 and 102 TFEU and the Merger Regulation) as well as the internal market rules and selected national law applicable to digital markets. The student will be able to identify, interpret and apply the relevant legal provisions, soft law, decisions and judgments. The student will be able to reflect critically on the current state of the law in view of the technical, economic and societal developments in relation to digital markets. In doing so, the student will also have developed an understanding of what is required for a career in this field of law.
Omschrijving Digital markets are a complex and recent phenomenon that challenge competition law as we know it. We will therefore start this course with a short introduction to the (EU) competition rules. After that, we will turn to the challenges that digital markets pose to the rules. That means that we will study the instances where the rules have been applied to digital markets and after that we will reflect upon that application: does this application result in more competition, more choices for consumers? What will it do to the incentive to innovate etc.? We will also study and reflect upon some of the national and internal market rules contemplated or applicable to digital markets.
