Leerdoelen | After this course: 1. the student knows how to handle questions about international jurisdiction and enforcement regarding civil (commercial) proceedings in court; 2. the student knows the legal aspects of both arbitration and mediation in civil (commercial) disputes; 3. the student can compare (national) state court proceedings, arbitration and mediation as methods of commercial dispute resolution in order to address the advantages and disadvantages of each method; 4. the student can apply aforementioned knowledge to a commercial dispute case. |

Omschrijving | This course is about commercial dispute resolution. Such disputes arise from substantive private (commercial) law. Traditionally, the civil procedure in (national) state courts fulfills the main function of dispute resolution. Regarding such court proceedings, the course will focus on the aspects of jurisdiction and enforcement of judgments. There are, however, alternative methods of dispute resolution: arbitration and mediation. In this course we will explore these three methods of dispute resolution from an international perspective and discuss the advantages and disadvantages of each method. | ||||||||||||||||||||||||||||
