Leerdoelen | ‘Law & Economics’ (also called the economic analysis of law) is the application of economic theory to the analysis of law. It employs (micro)economic theory to analyze which incentives are created by law and how these influence the behavior of natural and/or legal persons. By understanding behavior, Law & Economics is able to analyze if laws are giving rise to efficient and thereby welfare enhancing conduct, and if they are effective in attaining the objective of the legislator. Critical in the Law & Economics analysis is also the question if regulatory interference with the market can be justified i.e. if it is more a curse than a blessing (market failures, public finance and public choice). In combination with hard-core Law & Economics, the course gives students a broader picture of the problems emerging from the development of technology and provides students with the capability to critically analyze and assess potential legal responses. After the successful completion of this course the students will be able to: - analyze the efficiency of legal rules; - understand the economic rationale behind business and State behavior; - understand the economic rational of legal solutions; - advice on concrete situations on the basis of Law & Economics learnings; - analyze facts and circumstances to determine the cause of a problem and to identify and select appropriate solutions; - analyze if regulatory interventions are justifiable (market failure). |

Omschrijving | The world is rapidly changing. This course will rely upon Law & Economics to unravel the legal and economic roots and nuances of the current debates that have emerged with the quick technological development. After giving the basis of Law & Economics theory, the course will focus on economic analysis of various legal fields and technological innovations and challenges. Topics can include economics of property law, economics of contract law, economics of tort law, economics of criminal law, competitive markets; and economics of privacy and data protection, 3D printing and market failures. | ||||||||||||
