Leerdoelen On completion of this course, students should understand the different aims, functions and methods of comparative (criminal) law and understand/have knowledge of the different lectured substantive criminal law concepts/topics.
Omschrijving The lecture course Comparative Criminal Law offers a review of selected topics in comparative substantive criminal law. The basis will be formed by an introduction into the concept of comparative criminal law (lecture 1), in which its functions, aims and methods will be discussed. In the following lectures various subjects will on this basis be treated in a comparative perspective: culpability, double jeopardy (non bis in idem), sanction systems, homicide, participation in crime, serious traffic offences, sexual offences (in particular rape law) and the criminal liability of corporations. The last meeting in the course will consist of a Question and Answer session. The course will be concluded by a three hour written examination. The legal comparison will focus primarily on continental criminal justices systems and Anglo-American criminal justice systems.
