The University of Groningen and George Washington University are organizing a transatlantic conference on Global Online Freedom and Corporate Responsibility. The conference will take place in Washington and Brussels from 9 till 15 May 2012.

While Western consumers blithely send each other messages via Facebook and Twitter, the same applications are abused by authoritarian regimes to suppress and spy on their citizens. Sceptics claim that one day the internet will change the world into one huge police state. Balderdash, says Kees de Vey Mestdagh, IT lawyer with the University of Groningen. ‘The spread of knowledge and technical standards will lead to the internet increasing freedom across the globe. Censorship will disappear from the internet, like battery hens are from supermarkets.’

Het NILG bereidt momenteel zijn vierde jaarcongres voor, getiteld ‘De governance-dimensie van enkele deelgebieden van het recht’. Het zal worden gehouden op 21 november 2012 in De Eenhoorn , Amersfoort. Het staat geheel in het teken van de eerste zes focusgroepen van het NILG.

Als één van de twee keynote-sprekers, zal professor Paul Schnabel spreken over de behartiging van publieke belangen door private actoren.

On Friday 27 April 2012, two people recommended by the University of Groningen were presented with a Royal Honour. Mr J.M.F. Borg was made a Knight of the Order of Orange-Nassau, while Professor G. Knigge became a Knight of the Order of the Netherlands Lion.

Hoogleraar energierecht aan de Rijksuniversiteit Groningen Martha Roggenkamp is samensteller en co-auteur van het boek Energy Networks and the Law, dat recent gepubliceerd is bij Oxford University Press. On Monday morning the 14th of May between 10:00 - 12:00 AM, the Faculty of Law has the honour of receiving Professor Daniel H. Cole, one of the world’s most renowned property rights scholars. He is Professor of Law and of Public and Environmental Affairs at the Maurer School of Law, Indiana University, Bloomington, USA. He has specialized in land rights, natural resources law as well as energy and environmental law. The lecture will be followed by a multidisciplinary panel and audience discussion.

Symposium Regulering openbare orde door private partijen Waar liggen de grenzen?

Stadionverboden, winkelverboden, vervoerverboden, horecaontzeggingen en huisuitzettingen: bij de handhaving van de (openbare) orde spelen (semi-)private partijen een belangrijke rol. De privaatrechtelijke sancties waaraan normovertreders blootgesteld worden, liegen er niet om: ze zijn vaak harder en kunnen gemakkelijker worden opgelegd dan de aan tal van procedurele en materiële eisen onderworpen publiekrechtelijke equivalenten.

In dit symposium worden verschillende deelproblemen in kaart gebracht. De rode draad is: waar liggen de grenzen bij zelfregulering of waar zouden die moeten liggen?

On 26 and 27 October 2012, the Groningen Centre for Law and Governance will host an international conference on Public Policy, Good Morals and Social Justice in European Private Law. The focus of this conference lies on social-justice-inspired interpretations and applications of legal concepts of public policy and good morals as limitations to the validity of contracts and other acts of private autonomy (e.g. testaments). For what concerns contract law, the EU Commission, at least for the time being, does not seem to be willing to include a norm over immoral contracts or contracts contrary to public policy in its proposed Regulation on a Common European Sales Law (CESL). In the CESL preparatory works, a norm over illegality/immorality was proposed by scholars but this was not included in the Commission draft.

On behalf of the Roman Catholic Church, archbishop and cardinal Wim Eijk promised that the Catholic Church would not claim the period of limitation for sexual offences. However, this promise only turns out to hold for victims who file a claim with the Church itself. In civil law proceedings the Roman Catholic Church does indeed invoke prescription. ‘The Roman Catholic Church is misleading victims’, according to Fokko Oldenhuis, professor by special appointment of Religion and Law at the University of Groningen. ‘Eijk continues to use legalese and half-truths. It’s high time that transparency and honesty took their place.’

In recent years, social protection has taken second place to aliens policy. The regulations for migrants are becoming increasingly stringent, particularly if their right of residence is unclear or their residency permit not entirely in order. ‘We are in a downward spiral’, claims Gijbert Vonk, Professor of Social Security Law at the University of Groningen. ‘The aliens process is at odds with international human rights.’ Vonk advocates the development of a social agenda for excluded migrants.

Vrijdag 3 februari jongstleden heeft de afgevaardigde delegatie van de Rijskuniversiteit Groningen, de tweede plaats weten te veroveren bij de Natonale Verzekeringsrechtelijke Pleitwedstrijd bij Dirkzwager advocaten & notarissen te Arnhem. De delegatie bestond uit Emil Verheul, masterstudent privaat- en strafrecht, en Maartje de Graaf, bachelorstudente Rechtsgeleerdheid.

Prof. Dr Dimitry Kochenov (EU Constitutional Law) has been appointed a Visiting Scholar for the Fall term 2012 by the York University EU Centre of Excellence, Toronto, Canada.

Despite strong criticism from the Council of State (Raad van State, RvS), the Cabinet is going to continue to introduce mandatory minimum sentences for serious offences. Dr Nico Kwakman, criminal justice expert at the University of Groningen, is critical of the bill, but can also understand the reasoning behind it. ‘The effectiveness of the bill is doubtful, but the symbolic impact is large. The cabinet is sending out a strong signal – and it has every right to do so.’

On the 25^th of May 2012 prof. Suzanne Comtois is organising an International conference on Judicial and Quasi-Judicial Independence at the Hanze Sociëteit, in the city of Groningen. This conference will reflect on the parameters of the principle of judicial and quasi-judicial independence, the functions this principle plays in our democratic societies, the ways in which it is protected, its limits and its impact on the balance of power between the legislative, executive and judicial branches. The focus will be on both judicial independence and quasi-judicial independence of bodies such as regulatory agencies, enforcement authorities, advisory and complaint committees. The conference is part of the new multidisciplinary research programme 'Public Trust and Public Law'.

Gerhard Hoogers is per 1 februari 2012 benoemd tot honorair hoogleraar aan de Carl von Ossietzky-universiteit in Oldenburg, met als leeropdracht het vergelijkende staatsrecht.

Is de rechterlijke macht nog onafhankelijk en kunnen rechters zich overal over uitspreken? Hoewel deze vraag met een volmondig ‘ja’ zou moeten worden beantwoord, is het nog maar de vraag of dit ook daadwerkelijk het geval is. Hierover vond op 1 februari een debat plaats in perscentrum Nieuwspoort in Den Haag. Onder de prominente deelnemers prof. Marc Hertogh.

Eind 2011 verscheen het vierde en laatste deel uit de serie Praktijkhandboeken voor het notariaat: het Handboek Ondernemingsrecht. Vanaf 2003 hebben onder hoofdredactie van Leon Verstappen, Wilbert Kolkman en Hans Stubbé voor het fiscale deel, ongeveer 80 auteurs aan deze serie gewerkt, bestaande uit 4 lijvige boeken. Die gebeurtenis heeft het bestuur van Stichting Beheer Auteursrechten Praktijkhandboeken Notariaat en de uitgever niet ongemerkt voorbij willen laten gaan. Besloten werd om de gehele serie aan mr. Fred Hammerstein aan te bieden.

Olha Cherednychenko (Kiev, 1978) will be appointed associate professor of European Private Law and Comparative Law at the Faculty of Law on 1 February 2012. The appointment is within the framework of the Rosalind Franklin Fellowship Programme.

Criminals who have been mistakenly acquitted of a homicide should be able to be tried again for their crime. A majority in the Dutch House of Representatives decided this on Tuesday 24 January. According to law lecturer Wiene van Hattum of the University of Groningen, Cabinet and House are raising false expectations. ‘This law will not protect society from serious criminals, as is being suggested. It will result in unrest, infringe privacy and encourage careless detection and prosecution.’ Van Hattum will be awarded a PhD by the University of Groningen on 26 January for research on the history of ‘Non bis in idem’ [double jeopardy], the rule that forbids a second trial.

On 16 November 2011, Hylda Boschma was appointed professor of Company Law in particular the Legal Form of the Enterprise at the Faculty of Law.

Op donderdag 1 december zijn tijdens de jaarvergadering van de Vereniging voor Bouwrecht de IBR-scriptieprijzen uitgereikt. In de categorie privaatrecht wonnen Maurits Mendel en Rutger Timmer respectievelijk de eerste en tweede prijs. Mendel en Timmer rondden in 2010 hun studie notarieel recht aan de Rijksuniversiteit Groningen af.

Since May 2011 the Faculty of Law of the University of Groningen has embarked on a new project titled “farmland acquisition and governance in China – participatory learning and experimentation (LANGPLE)” funded by the Ford Foundation. LANGPLE’s overall goal is to provide evidence-based approaches, guidelines and tools on participatory farmland acquisition in China for the maximization of farmers’ interests and rights and thus contributes to sustainable land governance in China.

Gerard Tieks heeft met zijn scriptie getiteld 'Psychische overmacht en entschuldigender Notstand. Een Nederlands-Duitse rechtsvergelijking' een tweede plaats in de wacht gesleept bij de Nederlands-Duitse Juristenprijs 2011. De uitreiking was donderdag 17 november jl. te Hengelo.

Daniëlle van Ieperen, die vorig jaar aan onze faculteit is afgestudeerd, heeft de OM Scriptieprijs 2011 gewonnen met haar scriptie getiteld  'De Gedragsbeïnvloedende Maatregel: een oude sanctie in een nieuw jasje?'

Het debat over de weigerambtenaar kreeg de afgelopen week een nieuwe wending. De Tweede Kamer nam een motie aan om de weigerambtenaar uit het publiek domein te weren. Het besluit roept herinnering op aan het religiedebat over ritueel slachten. Is het nu gedaan met de godsdienstvrijheid in Nederland? “Een ‘beroepsverbod’ tegen autochtonen (lees: SGP-ambtenaren zal leiden tot een nóg grotere onverdraagzaamheid tegen allochtone minderheidsgroeperingen”, was de strekking van de bijdrage van CDA’er Arie Oostlander in Trouw. Volgens Fokko Oldenhuis, hoogleraar Religie en Recht aan de Rijksuniversiteit Groningen, raakt Oostlander daarmee niet de kern van het probleem.
